Home United offers an exciting concept in the Hamburger Ding, directly on the Kiez, with stylish co-working workplaces, sports and lounge areas as well as regular events and forms a member network, the Homeunity.


The following conditions apply to all services that Home United offers under the name Home United Co-Working and Services. They serve as a framework agreement for all current and future services without the need for express reference.


These conditions apply exclusively. The terms and conditions of the members who contradict these are already contradicted and have no validity.


The services offered are expressly not aimed at consumers.

 

 

1. Services and additional benefits

Home United provides the following services for the co-working places, which are already covered by the service fee:

 

  • Access to the property and use of the co-working spaces

  • Shared use of the facilities as well as the furniture in the co-working spaces and homeunity areas

  • unlimited access to high-speed wireless internet services

  • Reception service

  • fully equipped tea kitchen with coffee, tea, water

  • Shared use of unique common areas, especially lounges

  • Participation in selected homeunity events

  • Guard and security service

  • all operating and ancillary costs, electricity and heating costs

  • cleaning service

  • Shared use of the workout and sports zone, including equipment, shower and changing areas

 

The member is entitled to book the optional additional services specified in the Home United price list, in particular meeting and conference rooms. There is no entitlement to complete availability at any time.


Depending on the tariff chosen, the member receives a certain number of usage contingents. If the agreed usage quota is exceeded, the member has to pay for additional services separately. The remuneration for these services is based on the Home United price list in the currently valid version.

 

The monthly quota expires automatically at the end of the respective month. A transfer to another month as well as the crediting or reimbursement of unused contingents are excluded.


2. Reception and access

The members / authorized users are looked after by the staff of Home United Monday to Friday from 9:00 a.m. to 6:00 p.m., with the exception of public holidays.


The member has access to the co-working spaces 24 hours a day, 7 days a week. To ensure access, key cards / transponders are made available to the member. Home United must be notified immediately if a key card / transponder is lost or damaged. The loss or replacement of the key card / transponder must be replaced and will be charged in accordance with the Home United price list in the currently valid version.

 

3. User authorization and guests

The member may only use the co-working spaces himself or through the authorized users specified in the contract. The number of authorized users is limited to the number of workplaces booked by the member. The member has to register additional authorized users. The additional usage authorization is calculated separately in accordance with the Home United price list in the currently valid version.


The specified authorized users should exclusively be employees of the member or legal representatives of the member. Home United must be informed immediately of any changes in this regard.


The member may receive guests in the homeunity for professional purposes. Guests of the member must be reported by name to the reception service or security service in good time. Guests are only allowed to stay within the Homeunity when accompanied by the member / authorized user. Home United is entitled to refuse access to guests if there is an important reason for the guest or if the guest reception is unreasonable.

 

4. Use of the co-working space - rules, availability and events

The co-working places are made available to the member and the designated authorized users for mobile work. Any specifications going beyond the general structural requirements, such as compliance with certain maximum temperatures in summer, are not owed by Home United. Protection from competition or product range is excluded.

 

The member must ensure that the co-working places are not used for illegal, immoral or otherwise ethically and morally reprehensible business. This prohibition also includes the unauthorized downloading, copying or distribution of copyrighted material.


The member must treat Home United's facilities with care in accordance with the Homeunity Code and leave them in a usable and clean condition after use. The member has to take objects brought back with him. The member must immediately notify Home United of any damage.


If fixed co-working places are the subject of the concluded contract, Home United is entitled to assign other, equivalent co-working places to the member with a period of one week.


To strengthen the community, Home United will organize various events for members, authorized users and, if necessary, guests. These events will take place in the Homeunity, so that partial areas have to be temporarily blocked for the preparation and implementation and services may have to be restricted.


The implementation of events can lead to restrictions in use. Home United will endeavor to provide other workplaces within the Homeunity for this period if necessary.


The Internet access provided by Home United is operated by external providers. Home United therefore has no influence on the availability and bandwidth available. The member is aware that maintenance or technical difficulties may result in temporary unavailability and reduced bandwidth. The Internet access may only be used by the member for business purposes.


The member acknowledges that there is video surveillance in the communal areas for security reasons. The member undertakes to inform his authorized users about the video surveillance.

 

5. Tariffs, payment methods

All prices are net prices and do not include the applicable statutory sales tax and relate exclusively to the services offered.


Payments are to be made in advance immediately upon conclusion of the contract. If monthly payments are to be made, these are to be paid in advance by the 3rd working day of the month.


Payment is made by bank transfer, SEPA direct debit or credit card.

 

If direct debits are not redeemed or credits are withdrawn, a flat-rate reimbursement of € 10.00 will be charged.


The member is obliged to pay a security deposit to Home United at the beginning of the contract for all claims from the contract as well as its termination. Home United is required to keep the security deposit separate from its property. Interest is not paid on the security deposit. The security will be returned within eight weeks of the termination of the contractual relationship, but only to the extent that Home United has no claims against the member.

 

6. Inbox, use as business address

With separate bookings as part of the "Business address and postal service" service, the member can use the Home United address as c / o business address during the contract period. The service does not authorize entries in public registers, commercial or commercial registers; unless the address is designated exclusively as a postal address or as a dependent branch and the company's headquarters are identified as such.


If you have a membership of two months or more, you can also book the “Company headquarters” service during the contract period. The service authorizes the use of the address in normal business transactions and in the imprint of a website. It can be used as the sole business address and all associated registrations and entries are permitted.


By booking the “Business Address and Postal Service” or “Company Headquarters” service, mail will be accepted by the Home United reception service. The member gives Home United written authorization to receive for this purpose. The mail acceptance includes all letters and postcards of the daily mail including parcels and parcels up to a maximum of 5 kg. Bulky goods and oversized shipments are excluded from acceptance. Home United is not obliged to accept registered mail or orders or prepayment services for the member.


The member is obliged to pick up the mail sent to him immediately. Home United reserves the right to charge a storage fee from the third working day in accordance with the Home United price list in the currently valid version.


Shipments that have not been picked up will be forwarded to the known address after a maximum storage period of 90 days at the member's expense, returned to the sender or, if these options are not available, disposed of.


After the termination of the contract, the member is obliged to submit a request for forwarding by post immediately.

 

7. Term and Termination

When concluding the contract, the member can choose between a fixed term or an unlimited term.


If a fixed term has been agreed, the service contract ends automatically when the fixed term expires. Ordinary termination is excluded during the fixed term.


If the contract has been concluded for an indefinite period, each party has the right to terminate the contract with a notice period of 30 days to the end of the month.


Regardless of the agreed fixed term, the right to premature termination remains unaffected for both parties for an important reason.


The termination requires text form. A continuation of the use after the end of the contract period is already contradicted.

 

8. Repair

Home United is entitled to carry out repair work and structural changes that serve to preserve the building fabric, avoid hazards or prevent damage, after giving notice in a reasonable period of time and in consultation. There is no need to set a deadline in the event of imminent danger. A reduction in the usage fee due to repair work or structural changes is excluded. Compensation for damages is excluded unless the use of the workstations is interrupted for a disproportionately long time for reasons for which Home United is responsible.

 

9. Termination of the usage relationship

Upon termination of the service contract, the member is obliged to return the co-working spaces completely cleared of personal items and persons in a condition that - taking into account contractual wear and tear - corresponds to the condition at the time of handover. Any damage and contamination must be removed. If the member does not meet this obligation, a flat fee according to the Home United price list in the currently valid version will be charged for the final cleaning and any necessary repairs to a work surface and / or an office.


The member has to return all received key cards / transponders. If any key cards / transponders are missing on return, Home United is entitled to invoice them in accordance with the Home United price list in the currently valid version.

 

Objects or documents left behind can be stored at the member's expense and, if a deadline has not been set, they can be disposed of for a fee.

 

10. Data protection

Home United complies with the legal requirements for data protection. For details on handling personal data and the rights of those affected, reference is made to Home United's privacy policy.


Home United reserves the right to monitor parts of the Hamburger Ding with video cameras and to save the recordings insofar as and as long as this is necessary and legally permissible in individual cases, in compliance with the requirements of the Federal Data Protection Act and in compliance with the personal rights of members. The fact of the observation and the responsible body are made recognizable by signs.

 

11. Warranty, liability

Home United's liability for breaches of duties arising from or in connection with the co-working service contract services is limited to willful intent and gross negligence. This limitation of liability and any other agreed limitations or exclusions of liability do not apply to damage resulting from injury to life, limb or health that is based on an at least negligent breach of duty by Home United or one of the vicarious agents or vicarious agents, as well as for damage due to a breach of essential contractual obligations ; in these cases the statutory provisions apply.


The member shares the use of the areas with other people. Home United points out that the member is responsible for ensuring that objects brought along are adequately locked. Home United is not liable for stolen items. No liability is accepted for the cloakrooms either.

 

12. Final provisions

Home United is entitled to change these general terms and conditions with effect for the future. The changes will take effect when Home United notifies the changes, the member can take note of the changes and does not object within two weeks of receipt of the notification of change.


These general terms and conditions are subject to German law. The place of jurisdiction is Hamburg.
